Dear Sir/Madam:
On July 7, 2005, importers of certain carbon steel and stainless steel fasteners originating in or exported from the People's Republic of China and Chinese Taipei were informed that the Canada Border Services Agency (CBSA) had reviewed the Industrial Fasteners Institute (IFI) "Inch Fastener Standards, 7th Edition" and had determined that hex head cap screws were properly considered to be screws rather than bolts.
As a result of a request for re-determination and information submitted in support of this request, the CBSA has reviewed this matter and determined that certain fasteners identified as carbon steel or stainless steel hex head cap screws imported from China or Chinese Taipei are not goods of the same description as those covered by the Canadian International Trade Tribunal's Finding and Reasons. As a result, no SIMA-related duties should be assessed on importations of these goods. In the event of SIMA-related duties having been assessed on importations of these goods, importers can request a re-determination by the CBSA.
