Certain Laminate Flooring from the People's Republic of China and France
Information Sheet
This information sheet is to advise that a re-investigation pursuant to the Special Import Measures Act (SIMA) has been initiated on May 30, 2007.
- The re-investigation is part of the Canada Border Services Agency’s (CBSA) enforcement of the Canadian International Trade Tribunal’s (Tribunal) finding of June 16, 2005.
- The subject goods are normally imported into Canada under the following ten-digit Harmonized System classification number:
- It is anticipated that the re-investigation will be concluded on or before November 26, 2007.
- Notice of the completion of the re-investigation will be published in a customs notice.
- The normal values and amounts of subsidy established, if applicable, will be effective for the subject goods released from the CBSA on or after November 26, 2007, or the date of the decision letter to the exporter, whichever occurs first. Normal values and amounts of subsidy currently in place will expire on that date. An exporter will be considered cooperative if a complete response to the CBSA’s Request for Information is submitted on time and the exporter permits verification of this data.
- Where an exporter either does not provide sufficient information to determine normal values or does not permit verification of information submitted, normal values will be determined in accordance with a ministerial specification, which is currently calculated by advancing the export price of the goods by 30%. This represents the highest margin of dumping found for a cooperative exporter of subject goods during the original investigation.
- Similarly, if an exporter in China fails to provide a complete and accurate submission to the subsidy Request for Information (RFI) or verification is not permitted, the exporter will be deemed un-cooperative. The countervailing duty rate of 3.54 renminbi per square metre will apply to all un-cooperative exporters, and also to any new exporters that start to export subject goods from China to Canada after the initiation of the re-investigation. This is in accordance with the ministerial specification put in place at the final determination of the subsidy investigation.
- Importers are cautioned that new normal values and/or amounts of subsidy, when issued, may be higher than those currently in effect, and that this could result in additional assessments of anti-dumping and/or countervailing duty. In addition, when there have been changes to domestic prices, market conditions and/or costs associated with production and sales, the onus is on the concerned parties to advise the CBSA. Where changes have occurred and the CBSA has not been advised in a timely manner, the extent of these changes could warrant retroactive assessments of /sima-lmsi/i-e/countervailing duty.
- Importers are reminded that they should respond by July 9, 2007, to the RFI sent at the initiation of the re-investigation.
